Higgsfield Earn — Supplementary Terms & Conditions

These Supplementary Terms and Conditions ("Earn Terms") govern your participation in the Higgsfield Earn program ("Program"). These Earn Terms supplement the Higgsfield Terms of Service ("General Terms") available at [link]. In the event of any conflict between these Earn Terms and the General Terms, these Earn Terms shall prevail with respect to your participation in the Program.
By participating in the Program, you acknowledge that you have read, understood, and agree to be bound by these Earn Terms. Participation requires your explicit acceptance via the consent checkbox prior to accessing any campaign.
1. Eligibility & Regional Availability
1.1. The Program is available only in select regions. Higgsfield maintains an Allow List of eligible countries, which may be updated at any time at Higgsfield's sole discretion.
1.2. Campaign availability may vary by region and is subject to change by Higgsfield without notice. Certain campaigns may be restricted to specific countries or geographic areas based on advertiser requirements, regulatory considerations, or platform capacity.
1.3. Your eligibility to participate in the Program may be enabled or disabled based on your region of residence or the geographic distribution of your audience. Changes to regional availability do not constitute a breach of any obligation by Higgsfield.
1.4. Your eligibility to participate in the Program is based on the expected reach of your social media accounts, as determined by Higgsfield in its sole discretion.
1.5. You are responsible for ensuring that your participation in the Program complies with all applicable local laws and regulations in your jurisdiction.
1.6. Higgsfield reserves the right to suspend or terminate access to the Program for users in any region without prior notice where required by legal, regulatory, or business considerations.
2. Account Verification
2.1. To participate in the Program, you must complete the verification process for each platform on which you intend to create content. Verification methods vary by platform and may include email verification, bio code placement, or other methods as determined by Higgsfield.
2.2. Unverified accounts will not be eligible to view or participate in campaigns. If your account is not verified, you will be directed to complete the verification process and review these Earn Terms.
2.3. Higgsfield reserves the right to revoke verification status at any time if there is reason to believe that account information is inaccurate, misleading, or obtained through fraudulent means.
3. Content Verification & Fraud Detection
3.1. All submissions to the Program are subject to review by Higgsfield's automated content verification system to determine whether content meets campaign requirements and the associated engagement metrics are authentic.
3.3. You acknowledge and agree that:
- Higgsfield's assessments are conducted automatically and may result in submission rejection without manual review.
- Higgsfield periodically updates its detection criteria and capabilities, and the methodology used to evaluate submissions may change without notice.
- Attempts to reverse-engineer, circumvent, or manipulate such detection systems constitute a material breach of these Earn Terms and may result in immediate and permanent removal from the Program.
- All determinations by Higgsfield are at its sole discretion and final.
4. Submission Acceptance & Rejection
4.1. Submissions may be rejected for the following reasons, including but not limited to:
a) Suspicious Activity
- Artificial or inorganic engagement (such as purchased views, likes, comments, or subscribers)
- Bot-generated or incentivized interactions
- View count or engagement manipulation of any kind
- Use of click farms, engagement pods, or similar services
- Submission of content originally created by another creator
- Duplicate submissions across multiple accounts
b) Non-Compliance with Campaign Requirements
- Content does not feature the required product, service, or user interface as specified in the campaign brief
- Content does not meet minimum quality or duration standards
- Content was not published within the specified campaign window
- Content was published on a platform or channel not approved for the campaign
- Promo code or tracking link was not included as required
- Content violates Higgsfield's General Terms (see in particular Section 5 "User Content and Certain Restrictions")
4.2. Higgsfield reserves the right to reject any submission at its sole discretion, even if the submission does not fall within the categories listed above.
4.3. Rejection of a submission does not entitle the creator to payment for that submission.
5. Appeals
5.1. If your submission is rejected, you may submit an appeal exclusively through the in-app appeal function. Appeals are accessible via the appeal button displayed on the rejection notification and through the appeal section within your account dashboard. These are the only channels through which appeals are accepted.
5.2. The appeal button will direct you to a structured appeal form. You must provide a clear explanation of why you believe the rejection was made in error and may attach supporting evidence such as screenshots or links.
5.3. Each rejected submission is eligible for one (1) appeal only.
5.4. Higgsfield will review appeals and issue a decision. Appeal decisions are final and not subject to further review. Higgsfield is not obligated to provide a detailed explanation of the appeal outcome.
5.5. Submitting an appeal does not guarantee reversal of the original decision. The review process may take time due to volume, and Higgsfield does not guarantee a specific response timeline.
5.6. Appeals submitted through any channel other than the in-app appeal function (including but not limited to email, social media, or third-party platforms) will not be reviewed.
6. Payouts & the Smart Payout System
6.1. Payouts for accepted submissions are calculated by Higgsfield. It determines compensation based on a variety of factors which may include, but are not limited to: channel size, median engagement, audience geography, campaign type, and performance metrics.
6.2. Payout rates are determined on a per-campaign and per-creator basis. The specific formula, weighting, and variables used by Higgsfield are confidential.
6.3. Payout amounts offered to you are personal and confidential. You agree not to publicly disclose, share, or discuss your specific payout rates, amounts, or payment terms with other creators or any third party.
6.4. Payouts are subject to submission acceptance, successful verification, and completion of all campaign requirements. Higgsfield reserves the right to withhold, delay, or reclaim payments in cases where fraud, policy violations, or errors are suspected or detected — including after initial payout.
6.5. Payment processing timelines may vary. Higgsfield will make commercially reasonable efforts to process payments promptly, but delays may occur due to verification, fraud review, payment provider processing, or high volume periods.
6.6. Higgsfield reserves the right to modify its payout system at any time and for any reason without prior notice.
7. Promo Codes
7.1. Where campaigns include promo codes, codes are assigned to individual creators and are non-transferable.
7.2. Certain promo codes may be subject to a validity window. When a validity window applies, the code must be used within the specified timeframe from the moment of claiming. Expired codes cannot be reactivated.
7.3. Misuse of promo codes — including but not limited to sharing, reselling, or using codes across multiple accounts — constitutes a breach of these Earn Terms.
8. Confidentiality
8.1. You agree to treat all communications with the Higgsfield Earn team as confidential. This includes, but is not limited to: direct messages, emails, campaign briefs, payout information, internal feedback, and any other correspondence.
8.2. You may not share, publish, screenshot, or otherwise disclose communications with the Earn team to any third party — including other creators, media outlets, or social media — without prior written consent from Higgsfield.
8.3. Violation of this confidentiality provision constitutes a material breach of these Earn Terms and may result in immediate removal from the Program and forfeiture of pending payouts.
9. Removal & Suspension
9.1. Higgsfield may suspend or permanently remove you from the Program at any time, with or without prior notice, for any reason, including but not limited to:
- Violation of these Earn Terms or the General Terms
- Fraudulent activity or suspected fraud
- Breach of confidentiality obligations
- Repeated submission rejections
- Repeated submission of baseless appeals
- Conduct that Higgsfield reasonably determines is harmful to the Program, its partners, or other creators
9.2. Upon removal, any pending payouts for unverified or disputed submissions may be withheld. Payouts for accepted and verified submissions completed prior to removal will be processed in accordance with standard payment timelines.
10. Indemnification by You
10.1. You agree to indemnify and hold Higgsfield, its affiliates, officers, and employees harmless from any losses, costs, liabilities and expenses (including reasonable attorneys’ fees) relating to or arising out of (i) the content you share under the Program, including whether it violates any third party rights or advertising/influencer laws, (ii) your violation of this Agreement, or (iii) your violation of any other laws, rules or regulations. Company reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with Company in asserting any available defenses.
11. Limitation of Liability
11.1. Higgsfield provides the Program on an "as is" and "as available" basis. Higgsfield makes no guarantees regarding campaign availability, payout amounts, platform uptime, or the outcome of any submission or appeal.
11.2. Higgsfield shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your participation in the Program.
11.3. Higgsfield's total liability to you in connection with the Program shall not exceed the total amount of payouts actually received by you in the twelve (12) months preceding the claim.
12. Dispute Resolution
12.1. Any dispute between you and Higgsfield arising from this Program shall be decided in the state or federal courts seated in the County of San Francisco, California and under California law.
12.2. You and Higgsfield may bring claims against the other only on an individual basis and not on a class, representative or collective basis.
13. Modifications
13.1. Higgsfield reserves the right to modify these Earn Terms at any time. Updated terms will be posted at [link] with a revised "Last updated" date.
13.2. Continued participation in the Program after changes are posted constitutes acceptance of the modified terms.
14. Consent
By checking the consent checkbox and participating in the Program, you confirm that:
- You have read and understood these Earn Terms in full.
- You agree to be bound by these Earn Terms, the General Terms, and the Content Moderation Policy.
- You understand that violations may result in submission rejection, payment withholding, or removal from the Program.
- You acknowledge that payout rates and communications with Higgsfield are confidential.
